Incapacity Planning Package

If you are not ready for a new will, or already have one you are happy with, you can still decide who acts for you if you cannot act for yourself. This package covers the documents that work while you are living.

What the four documents do

• Financial power of attorney. Someone you trust handles your money and property if you cannot.
• Health-care power of attorney. Someone you choose makes treatment decisions when you cannot.
• Living will. Your wishes about life-prolonging treatment.
• HIPAA authorization. Lets your doctors keep the people you choose informed.

Who it suits

• Adults in North Carolina who already have a will they are happy with.
• Adults who want these protections now and a will later.
• Young adults turning 18.
• If you also need a will, the Will-Based Estate Plan includes all four documents.

What is included

• A planning consultation about your choices.
• Drafting of all four documents on the North Carolina statutory forms.
• A plain explanation of each choice you make, and one round of revisions.
• A signing meeting.
• Your signed documents and a closing package, including how to revoke each document later.

Price

$600 per person.

Outside costs are extra: notary fees (up to $10 per signature), a paid witness if one is needed, printing and mailing, and any recording fees or certified copies.

What is not included

• A will or a trust.
• Recording a power of attorney with a register of deeds.
• Review of documents you already have, beyond instructions for revoking earlier ones.
• A guardianship proceeding, or a situation where your capacity is already in question.

The $600 price is per person. A couple who both want the package each pay $600.

1. Talk. We go over your situation and the choices each document asks you to make.
2. Draft. I prepare the four documents.
3. Review. You read the drafts, and I make one round of changes.
4. Sign. A signing meeting, then your closing package.
